Stud Agreement

For breeders using one of our studs.

Section 1: PARTIES

This agreement is between Lilac Blossom Yorkies, owned and operated by Tara Williams of Walden, New York (the "Stud Owner"), and the person named on this form (the "Dam Owner"). It covers breeding the dam named on this form to the stud named on this form.

Section 2: LITTER REGISTRATION

The Stud Owner will sign the registry's litter application (CKC where applicable) when the Dam Owner applies to register a litter by the stud named in this agreement.

Section 3: RESTUD SERVICE

If the breeding does not produce a pregnancy, the Stud Owner will provide a return stud service to the same female named in this agreement.

Section 4: SEMEN TRANSPORT

If semen is shipped, the Dam Owner is responsible for the cost of collecting and shipping it, including when the insemination does not result in a pregnancy.

Section 5: NOTICE OF FAILURE TO CONCEIVE

If the dam does not become pregnant, whether she was present for the breeding or semen was shipped, the Dam Owner will tell the Stud Owner promptly after the pregnancy check, and in any event before the dam's next heat cycle begins, and request a return stud service on that heat cycle.

Section 6: STUD AVAILABILITY

When a return stud service is granted and the stud named in this agreement is not available, the Stud Owner will provide another suitable stud.

Section 7: STUD FEE PAYMENT

The stud fee entered on this form must be paid in full before any attempt to breed is allowed. If for any reason the stud does not tie the female, and collecting and inseminating is not used, the Stud Owner will return the stud fee before the Dam Owner leaves the premises.

Section 8: ONLY THIS SIRE

The Dam Owner will not allow the dam to be bred to any male other than the stud named in this agreement during the heat cycle covered by it, unless the Stud Owner agrees in writing. Doing so voids this agreement.

Section 9: CARE OF THE PUPPIES

The Dam Owner will not sell or give any puppy from this breeding to a pet store, broker or retail seller, and will not surrender or abandon any puppy at a shelter.

Section 10: HEALTH OF THE DAM

The Dam Owner guarantees that the dam is healthy, current on vaccinations, and free of disease, including brucellosis. If the dam has been bred before, the Dam Owner will provide a current brucellosis test before the breeding when the Stud Owner asks. The Dam Owner is responsible for the cost of any health testing of the dam.

Section 11: RELEASE OF LIABILITY

To the fullest extent permitted by law, the Dam Owner releases the Stud Owner, and the Stud Owner's family and representatives, from all claims arising from the breeding, including any accident or injury to the dam or to any person or animal accompanying her, even after leaving the premises where the stud is located, except for harm caused by the Stud Owner's gross negligence or intentional misconduct.

Section 12: DEFINITION OF A LITTER

A litter means one or more living puppies born from the breeding. A litter fulfills the Stud Owner's obligation under this agreement.

Section 13: BURDEN OF EVIDENCE

The Stud Owner may ask for veterinary proof that the dam did not become pregnant from a prior breeding. The Dam Owner pays for the veterinary tests, such as an ultrasound or x-ray, and for taking the dam to the clinic.

Section 14: GOVERNING LAW AND VENUE

This agreement is governed by the laws of the State of New York. The parties will first try in good faith to resolve any dispute through mediation. Any legal action will be brought only in the county where the Stud Owner resides.

Section 15: AGREEMENT TO TERMS

By signing, the Dam Owner agrees to all of the terms in sections 1-15 and understands that no other agreements are made or implied.

By typing or drawing a signature below, the signer confirms they have read and understood this entire Stud Agreement, that they are signing it voluntarily, and that an electronic signature is as binding as a handwritten one.
