Puppy Back Agreement
This form is for the sale of one of our adults in exchange for a puppy back.
Section 1: THE SELLER
The Seller in this agreement is Lilac Blossom Yorkies, owned and operated by Tara Williams of Walden, New York, the owner of the adult dog being sold (the "Dog").
Section 2: PUPPY BACK AS PAYMENT
The Buyer is paying for the Dog by providing a puppy back to the Seller, as described in this agreement.
Section 3: SELLER REQUIREMENTS
The Seller requires that the puppy back be a female. The Seller will take second pick from the first litter the Buyer produces from the Dog. If the first litter has only one female, the Seller may instead take first pick from the second litter the Buyer produces with the Dog. If there is no living female in the second litter, the Seller will pick a male puppy from that litter.
Section 4: SECOND PICK DEFINED
For this agreement, "second pick" means the Seller's favorite puppy in the litter, other than the one puppy the Buyer chooses as the best puppy in the litter.
Section 5: FIRST PICK DEFINED
For this agreement, "first pick" means the puppy in the litter that the Seller prefers above all others.
Section 6: BUYER OBLIGATIONS
The Buyer will show the Seller every puppy in the litter before the Seller makes the pick.
Section 7: SELLER OBLIGATIONS
The Seller will make a timely pick after being shown all of the puppies, on whatever schedule the Buyer prefers, from the day of birth up to the age at which the Buyer sells puppies to other customers.
Section 8: IF THE PICK PUPPY DIES
If the puppy the Seller picked dies before pickup, the Seller and the Buyer agree that the Seller may choose another puppy that has not already been promised to another customer, or take a puppy from the Buyer's next litter.
Section 9: QUALITY OF THE PUPPY BACK
The puppy back is taken as is. The Buyer gives no guarantee about the health or breeding soundness of the puppy the Seller picks.
Section 10: NON-FULFILLMENT
If the puppy back has not been provided by the deadline entered on this form, the Seller may demand payment of the agreed value of the Dog entered on this form as payment for the Dog.
Section 11: CARE OF THE DOG
The Buyer will provide the Dog with adequate care, shelter and food.
Section 12: REGISTRATION PAPERS
The Seller states that the Dog is registered. The Seller will hand over the Dog's original registration papers, signed over to the Buyer, so that registration transfers to the Buyer named in this agreement.
Section 13: FINANCIAL BURDEN OF CARE
The Buyer is responsible for all veterinary costs and any other expenses connected with owning and breeding the Dog.
Section 14: PICK-UP OF THE PUPPY
The Seller is responsible for all costs of picking up the puppy the Seller chooses, once the puppy is old enough to leave its mother.
Section 15: IF THE DOG SHOULD NOT BE BRED
If the Buyer decides at any time that the Dog should not be bred for any reason, the Buyer will either return the Dog to the Seller or pay the Seller the agreed value of the Dog entered on this form. If the Dog is returned, the Seller pays the cost of transportation.
Section 16: GOVERNING LAW AND VENUE
This agreement is governed by the laws of the State of New York. The parties will first try in good faith to resolve any dispute through mediation. Any legal action will be brought only in the county where the Seller resides.
Section 17: EXECUTION
This agreement is binding from the time the Seller delivers the Dog to the Buyer or to the Buyer's transport.
Section 18: AGREEMENT TO TERMS
By signing, the Buyer agrees to all of the terms in sections 1-18. This is the only agreement between the Buyer and the Seller about the Dog, and no other promises are made or implied.
By typing or drawing a signature below, the signer confirms they have read and understood this entire Puppy Back Agreement, that they are signing it voluntarily, and that an electronic signature is as binding as a handwritten one. A copy of the signed agreement will be sent to the email address entered on this form.
