Guardian Contract

For approved guardian homes participating in our breeding program.

Section 1: PARTIES AND PURPOSE

This Guardian Home Contract is between Lilac Blossom Yorkies, owned and operated by Tara Williams of Walden, New York (the "Breeder"), and the person named on this form (the "Guardian").

The Breeder places the Yorkshire Terrier described on this form (the "Dog") in the Guardian's home so that the Dog can live as a loved family companion while the Breeder keeps ownership of the Dog and the right to breed her or him as described below.

Section 2: OWNERSHIP AND CUSTODY

The Breeder keeps full legal ownership of the Dog, the Dog's registration papers, and every decision about whether, when and to whom the Dog is bred. The Guardian is entrusted with the day-to-day care, custody and control of the Dog.

The Guardian will not sell, give away, lend, breed, board, or transfer the Dog to anyone else, and will not allow the Dog to be bred, without the Breeder's written permission.

Section 3: RESPONSIBILITIES OF THE GUARDIAN

The Guardian agrees to: provide a safe, loving and healthy home; provide proper food, fresh water, exercise, grooming and socialization; keep the Dog indoors as a family companion and never leave the Dog outside unattended; keep the Dog's vaccinations, parasite prevention and routine veterinary care up to date; follow the veterinarian's medical advice; and tell the Breeder promptly about any illness, injury or concern.

The Guardian will protect the Breeder's breeding program. That includes keeping the Dog away from other dogs that could breed with the Dog, and keeping the Dog's coat, weight and condition suitable for breeding.

Section 4: BREEDING RIGHTS

The Breeder has the right to breed the Dog for the number of litters entered on this form, beginning when the Breeder, on the advice of the Breeder's veterinarian, decides the Dog is ready. The Guardian agrees to make the Dog available for breeding and for the veterinary appointments that go with it.

If the Dog is female, the Guardian will tell the Breeder promptly at the first sign of a heat cycle. If the Dog is male, the Guardian will make the Dog available for breeding when the Breeder asks.

Section 5: BREEDING SOUNDNESS

Whether the Dog is healthy and sound enough to be bred will be decided by the veterinarian chosen by the Breeder. The Guardian agrees to make the Dog available for any check-up the Breeder requests with that veterinarian. A different veterinarian's opinion about the Dog's breeding soundness will not decide whether the Dog is bred; the Breeder has the final say on all breeding decisions.

Section 6: WHELPING AND PUPPIES

The Breeder may ask that a female Dog stay in the Breeder's home before the expected whelping date and until her puppies are weaned. The Guardian may offer to have a litter born in the Guardian's home, but only if the Breeder agrees in writing.

All puppies born to the Dog belong to the Breeder. Unless the Breeder agrees otherwise in writing, the Guardian will not receive any additional payment for whelping or helping to care for a litter. The Guardian is responsible for getting the Dog to and from the Breeder or the Breeder's veterinarian when the Breeder gives reasonable advance notice.

Section 7: VETERINARY CARE AND EXPENSES

The Guardian pays for the Dog's routine care, including food, grooming, vaccinations, parasite prevention, and annual check-ups, and for any illness or injury that is not related to breeding.

The Breeder pays for veterinary care that is related to breeding, such as breeding-related health testing, pregnancy checks, whelping care and C-sections, when the Breeder has arranged or approved it in advance. In an emergency the Guardian will contact the Breeder as soon as possible and will not authorize elective treatment of the Dog without the Breeder's consent.

Section 8: GUARDIAN SERVICE FEE

In return for the Guardian's care of the Dog and the services described in this contract, the Breeder will pay the Guardian the service fee that the Breeder and the Guardian agreed to and the Guardian entered on this form, at the times stated there.

The service fee is payment for the Guardian's services only. It does not give the Guardian any ownership interest in the Dog, any puppy, or the Breeder's business.

Section 9: INDEPENDENT RELATIONSHIP; NO PARTNERSHIP

The Guardian is an independent person providing a home and care for the Dog. Nothing in this contract creates a partnership, joint venture, employment, or agency relationship between the Breeder and the Guardian.

The Guardian has no authority to sign for or bind the Breeder, has no ownership interest in the Dog, its puppies or the Breeder's business, and is not responsible for the Breeder's business losses.

Section 10: TERM AND COMPLETION OF THE PROGRAM

This contract starts when it is signed and continues until the Dog has had the number of litters entered on this form or until the Breeder retires the Dog from breeding (for example on veterinary advice), whichever comes first.

When the program is complete, and if the Guardian has followed this contract, the Breeder will transfer ownership of the Dog to the Guardian in writing and provide the registration papers if the Breeder holds them. The Guardian agrees to have the Dog spayed or neutered by a licensed veterinarian at the Guardian's cost within a reasonable time after ownership is transferred, unless the Breeder agrees otherwise in writing.

Section 11: TERMINATION

The Breeder may end this contract if the Guardian does not follow its terms, including failing to provide adequate care or a safe home, failing to communicate reasonably, or failing to tell the Breeder promptly about heat cycles or health problems.

The Guardian may end this contract by giving the Breeder written notice (a text message or email is acceptable) and returning the Dog as described in the next section.

Section 12: RETURN OF THE DOG

When this contract ends for any reason before the program is complete, the Guardian will return the Dog to the Breeder in good condition, on the date the Breeder sets in the notice (which will allow reasonable time for travel), together with the Dog's papers, medical records and other documents.

Section 13: RELEASE OF LIABILITY

To the fullest extent permitted by law, the Guardian releases the Breeder, and the Breeder's owners and representatives, from claims for injury or damage to the Guardian, the Guardian's household, guests or property arising from keeping the Dog in the Guardian's home or from transporting the Dog to or from the Breeder, except for harm caused by the Breeder's gross negligence or intentional misconduct.

The Guardian is responsible for the Dog's actions while the Dog is in the Guardian's care.

Section 14: GOVERNING LAW AND VENUE

This contract is governed by the laws of the State of New York. The parties will first try in good faith to resolve any dispute through mediation. Any legal action will be brought only in the county where the Breeder resides.

Section 15: AGREEMENT TO TERMS

This contract is the entire agreement between the Breeder and the Guardian about the Dog and replaces any earlier discussion. It can be changed only in writing signed by both parties. If any part is found unenforceable, the rest stays in effect.

By typing or drawing a signature below, the signer confirms they have read and understood this entire Guardian Home Contract, that they are signing it voluntarily, and that an electronic signature is as binding as a handwritten one. A copy of the signed agreement will be sent to the email address entered on this form.
